| 1. Parties | |
|
1.1: This agreement is between AltunHOST (referred to as AltunHOST) providing the services listed in the services section and the individual/entity (referred to as the Customer) specified in the new customer registration section, and it specifies the terms under which the services will be provided through the website (referred to as the Site) at www.AltunHOST.com. 1.2: The parties acknowledge, accept, and commit to the accuracy of the information provided in this agreement. |

| 2. Subject | |
|
2.1: This agreement will regulate the services the customer will receive based on the information provided by the customer during their website actions, orders, messages, and registration, and the payments the customer will make to AltunHOST for these services. These services and transaction details are outlined below. 2.2: Membership information refers to the details entered during the registration process. These details will be used for the customer's actions, and it is assumed that the customer and the member have entered this information correctly, completely, and accurately. |

| 3. Responsibilities | |
|
3.1: AltunHOST will provide the services as requested by the customer in their order. Upon the acceptance of the order, AltunHOST will acknowledge the payment of the relevant fee and commit to providing the service as specified in the order. 3.2: The payment method and the total amount, including VAT differences, will be indicated by AltunHOST, and the customer will be informed of the payment to be made based on their monthly or yearly preference. 3.3: After the order is accepted and the processes are confirmed, AltunHOST will provide the customer with the control panel, FTP, SQL, and email user accounts and passwords related to the service, and the service will begin. The customer is responsible for the accounts and passwords, and any damages resulting from these issues will be the customer's responsibility. 3.4: The customer commits to complying with the statements and warnings issued by AltunHOST regarding the services received. The customer acknowledges, accepts, and commits to following all warnings or notifications issued by AltunHOST while using the hosting account. The customer cannot distribute or sell the services provided for free and unlimited to third parties, whether paid or free, limited or unlimited. 3.5: The customer commits not to access files or programs they are not authorized to access using the software and programs provided in the service. The customer will ensure no problems are created as a result of this, and any issues or problems caused will be the customer's responsibility. 3.6: The customer accepts and commits to bear any taxes, duties, or similar obligations that apply during the use of the domain, hosting, or services provided, either during the contract period or after the agreement is signed. 3.7: Müşteri, hizmeti dahilinde barındırdığı tüm dosya, doküman ve programlardan, web sitesi ve e-mail hizmetleri ile kullanacağı ve faydalanacağı tüm işlemlerden kendisinin sorumlu olduğunu, söz konusu veri, lisans, bilgi ve beyanların yasalara aykırılığından doğabilecek tüm hukuki ve cezai sorumluluğu kendisinin karşılayacağını kabul ve taahhüt eder. İşbu konuda doğabilecek sorunlardan AltunHOST herhangi bir sorumluluk kabul etmez. AltunHOST, sayfaları gönderilmeden önce gözden geçirmez, doğrulamaz, ciro etmez veya kullanıcı tarafından yapılmış sayfalar için herhangi bir şekilde sorumluluk almaz. AltunHOST, kullanıcı hesaplarını bu ana hatları ihlal ettiği için ve başka bir sebeple AltunHOST'un kendi veya kullanıcılarından herhangi birinin işine zararlı olduğuna inandığı için fesih edebilir. AltunHOST, hukuka aykırılık eden fiilleri ve eylemleri öğrendiğinden itibaren müşteriye haber vermeden silme hakkına sahiptir. 3.8: AltunHOST, sağladığı hizmet içerisinde bulunan müşteri verilerinin hatalı kullanımlarından, veri içeriklerinden, e-mail ile kullanılan tüm verilerden doğabilecek hiçbir maddi veya manevi zararlardan sorumlu tutulamaz. Bu verilerin yedekleme ve saklama yükümlülükleri müşteriye aittir. AltunHOST, hizmetlerinde meydana gelebilecek kesinti veya veri kaybından dolayı oluşabilecek hatalardan, zarardan ve ziyandan sorumlu değildir. Verilerin yedeklenmesi, sözleşme metninde aksi belirtilmediği sürece müşterinin sorumluluğundadır. 3.9: AltunHOST, müşteri tarafından sipariş verilmiş ve ödemesi sorunsuz olarak gerçekleştirilmiş domain name tescil işlemlerini yürütecektir. Tescil edilen ve sipariş ile kabul edilen tescil talebi ile ücreti ödenen domain name'in sahibi müşteridir. AltunHOST, bu konuda müşterinin talepleri doğrultusunda domain name üzerinde işlem yapabilecektir. Müşteri, domain name üzerinde bir düzenleme, değişiklik ve transfer taleplerini en kısa sürede iletecektir. Tarafımızdan tescil edilen alan adlarının (com, net, org, ...) The Directi Group ve OnlineNIC firmalarına transfer işlemi kesinlikle gerçekleştirilmeyecektir. 3.10: AltunHOST, hiçbir şekilde müşteri kredi kartı bilgilerini saklı tutmamaktadır. Ödemelerin aylık/yıllık takibi müşteri sorumluluğundadır. AltunHOST aylık/yıllık ödemelerin gecikmesi durumunda mevcut hizmetin durdurulması hakkına sahiptir. 3.11: AltunHOST, ücretsiz yedekleme hizmeti sunmamaktadır. Müşteri, ücretli yedekleme hizmetine sahip değilse kendi yedeklerini almakla yükümlüdür. Aksi halde AltunHOST yaşanabilecek veri kaybından sorumlu değildir. 3.12: AltunHOST, süresi dolmuş alan adı, hosting veya diğer sunduğu hizmetleri süre bitiminden sonra durdurma, hizmeti tamamen iptal etme hakkını saklı tutmaktadır. Süresi dolmuş veya ödemesi sağlanmamış hizmetlerin iptalinden sonra herhangi bir veri kaydı tutma yükümlülüğü bulunmamaktadır. 3.13: AltunHOST, Alan adı Tescil hizmetlerinde birebir olarak ICANN ve alan adı ana üreticisi pozisyonunda yer alan REGISTRAR şirketlerin şartlarına uymaktadır. Bu konuda tüm sorumluluklar ve süreçler REGISTRAR şirketlerin şartları olarak geçerlidir. Alan adlarının tescil süreçleri yazılım sistemleri tarafından yönetilir, bu yazılımlar AltunHOST ve Registrar şirketler üzerinde çalışmaktadır. Bu çalışma sırasında yaşanabilecek arıza veya erişim sorunlarından dolayı tescil, güncelleme, düzenleme, değişiklik, silme gibi süreçlerde yaşanabilecek hatalarda Müşteri tüm sürecin kontrolünden sorumludur. 3.14: AltunHOST, sağladığı tüm hizmetlerde adult (+18), bahis, darkweb vb. temalı hiçbir yayına izin vermemektedir. Tespiti halinde AltunHOST, müşterinin ilgili hizmetini kalıcı olarak kapatma ve müşterinin kişisel bilgilerini olası mahkeme süreci için saklama hakkına sahiptir. 3.15: AltunHOST, hosting hizmetlerinde belirttiği limitsiz kavramı yalnızca web sitelerindeki kullanım için geçerlidir. Dosya depolama, yedekleme, dosya yükleyip download'a sunma vb. gibi işlemler için kullanılamaz. Kullanılması halinde AltunHOST, hizmeti askıya alabilir veya kalıcı olarak kapatabilir. Müşteri bu durumu kabul ve taahhüt eder. 3.16: AltunHOST, Alan adı Tescil Hizmetlerinde, whois bilgisi değiştirme ve doğruluğunun sorumluluğu, alan adı tescil şifresi sorumluluğu, transfer kilidi sorumluluğu müşteriye aittir. Bu bilgi AltunHOST kontrol paneli üzerinden planlı bakım ve %0.001 altında kalan süreçte yaşanabilecek arıza durumları haricinde 7/24 müşteri tarafından değiştirilebilmektedir. 3.17: AltunHOST, alan adı tescil hizmetlerinde sağlama şartlarını ve fiyatlarını bilgi vermeksizin değiştirme hakkına sahiptir. Bu düzenleme, yıllık ödeme yapılan alan adlarının servis yenilenmesi sürecinden sonra yürürlüğe girecek olup servis yenilenmesi sırasında güncel fiyat ve şartlar açık ve eksiksiz olarak belirtilmektedir. Müşteri, yenileme yapmak istemezse veya yenilemeyi farklı bir şirket üzerinden yapmak isterse, bu durumda registrar şirketlerin ve ICANN'ın koymuş olduğu kurallar çerçevesinde işlem yapma hakkına sahiptir. 3.18: AltunHOST suspends domain names of customers who do not perform renewal processes for domain services on time. The suspension process varies according to the time specified by the domain's registrar. During this period, the primary customer who purchased the domain can renew it by paying the annual renewal fee and regain the usage rights. If the domain is not renewed during this period, it will enter the REDEMPTION PERIOD. In this phase, the domain rights will be transferred from the customer and placed under the discretion of our company and the registrar. During this period, AltunHOST or the Registrar has the right to sell the domain to another company. If the old customer or a new customer wants to retrieve the domain during the Redemption Period, they can do so by paying a penalty fee, which varies according to the domain registrar, but is approximately 85 USD. If the domain is not retrieved after the Redemption Period, the process will be under the discretion of the Registrar, and it will no longer be possible to retrieve the domain through AltunHOST. 3.19: AltunHOST does not sell domain services as a product. Instead, it is a service where the right to use is granted for the duration for which the fee is paid. Therefore, if the fee is not paid during the domain's expiration period, this right may be transferred to someone else. 3.20: AltunHOST does not provide mass email sending or unsolicited email services (spam e-mail). These types of transmissions cannot be made through the services provided. In the case of such transmissions being detected, AltunHOST will block the mail transmission protocol (SMTP) for 12, 24, 48, and 72 hours, respectively. If the transmission is repeated, SMTP access will be permanently blocked for the service. 3.21: AltunHOST does not allow long-term full resource (CPU, RAM, bandwidth, etc.) usage in its services. If resource usage reaches 100%, it should not last for more than 1 minute. Otherwise, AltunHOST has the right to suspend the service or restrict resources without any inquiry. The service can be suspended until the service duration ends. In this case, no refund will be made. |

| 4. Duration | |
|
4.1: This agreement comes into effect when the order and payment transactions are transmitted to AltunHOST via the internet, and the specified rights and obligations of both parties begin. 4.2: The duration of the agreement is as long as the payment period selected by the customer for the relevant service during the order process. After the payment is received, service cancellation and refund requests cannot be made. 4.3: If neither party notifies the other that the contract will terminate 10 business days before the expiration of the contract, the contract will be extended for the same duration as the previous contract with the same terms and conditions. (Changes in pricing are excluded.) |

| 5. Fee | |
|
5.1: The fee to be paid for the services specified in this contract is the amount indicated during the order process. The specified fees will be calculated by adding VAT afterward and shown to the customer for collection. 5.2: AltunHOST reserves the right to change prices and tariffs for future services without prior notice. The customer agrees, declares, and undertakes to accept any potential changes. 5.3: The fee is paid in Turkish Lira, converted based on the effective selling rate of Garanti Bankası on the invoice date. 5.4: Unless otherwise specified on the relevant product sales pages or a special agreement is made with the customer, the fee must be paid by credit card if a credit card payment instruction is given during the order process. If no such instruction is given, the customer must pay via the bank account numbers listed at bank accounts or make a cash payment to AltunHOST by the 5th business day after the invoice issue date. 5.5: In case of late payment, AltunHOST reserves the right to issue an exchange rate invoice. 5.6: AltunHOST reserves the right to suspend or activate the related service until the customer completes the payment. |

| 6. Suspension | |
|
6.1: If there is a payment issue, provision problems for customers with credit card payment instructions, or violations of terms and obligations, AltunHOST reserves the right to suspend all services, including email, web, and FTP accounts. 6.2: During this period, email, web, and FTP access will be blocked, and incoming emails will be rejected. | |
| 7. Termination | |
|
7.1: If the customer fails to fulfill their responsibilities and obligations under any provision of this agreement or if it is determined that the information provided by the customer on the front page of this agreement is false, AltunHOST has the right to terminate the agreement unilaterally without any notice if the suspension described above lasts for more than 3 days. 7.2: After such termination, the customer agrees, accepts, and undertakes that they will not be entitled to a refund for the remaining period, and will pay a commercial penalty equal to 5 times the applicable contract price at the time of termination. 7.3: The customer has the right to terminate this agreement before the normal contract period expires, by giving written notice 10 days in advance. 7.4: If the customer terminates or cancels the agreement and/or service before the expiration date, the customer agrees, accepts, and undertakes to pay the service fee for the remaining period until the contract/service end date in advance. |

| 8. Communication and Information Addresses | |
|
8.1: For all notifications arising from this agreement, the parties have accepted, declared, and undertook that the postal addresses specified in the order will be considered as their legal residence. 8.2: Any notifications made to these addresses will be deemed delivered, even if not received by the parties. Any changes to these addresses will be valid unless written notice is given to the other party. 8.3: AltunHOST may send messages, information, letters, notifications, payment notices, account statements, and account summaries to the electronic mail address assigned to the customer during the contract period. The customer agrees, accepts, and undertakes that they cannot claim non-receipt of such electronic communications, and that these communications will be considered legally delivered 1 day after being sent. |

| 9. Payment Default | |
|
9.1: If the customer does not make the payment within 3 days after the application date for the services received, they will be considered in default. In this case, AltunHOST may issue an exchange rate invoice. The customer agrees to pay this invoice. 9.2: The customer agrees to pay 50% of the remaining debt as a penalty, 10% as attorney fees, and any other legal costs if AltunHOST has to open a lawsuit or initiate enforcement proceedings for the collection of any debt arising from this agreement. 9.3: The customer agrees, accepts, and undertakes that AltunHOST is authorized to apply for an attachment order and precautionary injunction for the collection of debts under this agreement, and that they will bear the commission and fees for any bank guarantees if required by the court. |

| 10. Jurisdiction and Enforcement Offices | |
|
10.1: This agreement consists of 10 articles and subheadings, and has been read, understood, and signed by both parties. (The agreement is deemed concluded when the order is approved and sent to AltunHOST via the internet). AltunHOST may add new clauses or subheadings, remove them, or make changes to the clauses as necessary. The customer agrees and undertakes to accept these changes in advance.
10.2: In case of any disputes arising during the implementation of this agreement, the Istanbul Courts and Enforcement Offices are authorized. 10.3: This agreement consists of 10 articles and 53 subheadings, and has been fully read and accepted by both parties. |
